Terms & Conditions

Welcome to The Compass Gallery (“we,” “us,” “our”). By using our website or purchasing from us, you (the “customer”) agree to the terms below.

 

General

These Terms apply to all purchases (both in person and online) and use of our website, including original artwork, prints, merchandise, and event tickets.

Website Use & Eligibility

Artistic Nudity / Mature Content Notice

Some artwork displayed on our website may include occasional artistic nudity or mature themes. This content is presented in a fine-art context and is not intended to be sexual. Viewer discretion is advised.

 

Children’s Privacy & Age Requirements

Our website is not intended for children under 13, and we do not knowingly collect personal information from children under 13. To make a purchase, you must be at least 18 years old (or have the involvement of a parent or legal guardian). If you believe a child has provided us personal information, please contact us and we will delete it.

 

Product Descriptions & Photography

 

We do our best to accurately display and describe each product. However:

  • Colors may vary due to screen settings and lighting.

  • Handmade and limited-edition items may include natural variations.

  • Measurements are approximate unless otherwise stated.

Pricing & Errors

 

All prices are listed in USD unless otherwise noted.

 

We reserve the right to correct errors in pricing, product details, discounts, promotions, shipping fees, and availability at any time, including after an order is submitted. If a pricing error affects your order, we may, at our discretion, cancel the order and issue a full refund, or contact you with the option to purchase at the corrected price.

Availability & Inventory

Many of our items are one-of-a-kind or limited in quantity. In rare cases, an item may become unavailable after purchase (for example, due to simultaneous in-gallery and online sales). If this happens, we will notify you promptly and provide:

  • a full refund, or

  • the option to apply your payment toward another available item (your choice).

 

Payment

 

We accept approved payment methods shown at checkout. Your card will be charged at the time of purchase unless otherwise noted.

 

We reserve the right to cancel or refuse orders for suspected fraud, unauthorized transactions, or abuse of our policies.

 

Payment Plans

Payment plans are available for online and in-person sales of original artworks only. A minimum of 10% must be paid upon purchase as a down payment, and the Compass Gallery will contact the customer to work out a customized payment plan to pay off the remaining balance. The full price must be paid within one year (12 months) of purchase. The art remains property of the original owner, and ownership does not transfer to the customer until the purchase price is paid in full. The artwork will not be released, delivered, or made available for pickup until paid in full.

 

If any balance remains unpaid after the 12-month deadline, interest will begin to accrue on the unpaid balance starting on day 366 at 10% per annum, unless a different interest rate is stated in writing in the customer’s payment plan agreement. Interest will be calculated on the unpaid balance and may be billed monthly until paid in full.

 

If the balance is not paid in full after 18 months, The Compass Gallery may cancel the payment plan and return the artwork to inventory for sale. Upon cancellation:

  • The down payment will be converted to store credit.

  • All additional payments made toward the artwork are non-refundable (and will not be converted to store credit).

We will make a good-faith effort to contact the purchaser using the information provided at checkout before canceling the plan.

 
Sales Tax

 

We collect sales tax where required by law based on the location the purchase was made.

 

Shipping

Processing times: Most orders will ship in the month following the end of the current exhibition unless otherwise stated on the product page. Exhibition dates can be found at www.thecompassgallery.com/gallery.

 

Shipping address: Customers are responsible for providing an accurate shipping address. We are not responsible for delivery issues caused by incorrect or incomplete addresses.

 

Once an order is in the carrier’s possession, delivery timelines are the responsibility of the shipping service.

If a customer receives an item and requests a change (including a different shipping address, alternate delivery arrangement, framing change, or other customer-initiated modification), the customer is responsible for the cost of shipping the item back to us and for reshipping it to the customer. If the return or reshipment is needed due to an error on our end or a confirmed carrier issue (such as damage in transit), The Compass Gallery will cover the reasonable costs of return shipping and reshipment.

If a package is returned to us due to being unclaimed or undeliverable, we may:

  • reship (shipping fees may apply), or

  • refund the item cost minus any shipping/handling costs.

 

Local Pickup

If local pickup is selected, the purchase will be available at the Compass Gallery (250 W Center St #101, Provo, UT 84601). Prints and other merchandise can be picked up at this location during regular business hours (12-8pm, Thursday-Saturday unless stated differently on our website). Most original artworks purchased as a part of the current exhibition will be made available for pickup in the month after the show ends. Customers who purchased such pieces will be notified when their purchase is ready, at which point it can be picked up during business hours. Exhibition dates can be found at www.thecompassgallery.com/gallery.

 

If you purchased a piece that is not part of the current show it may be available sooner; we will contact you with confirmation and pickup availability.

 

The customer (or whoever is picking up the piece) will be required to show the gallery staff member their order number (which can be found on digital receipt) upon pickup.

Local Delivery (Utah and Salt Lake Counties)

Free local delivery is available for qualifying orders totaling $2,000 or more with a delivery address in Utah County or Salt Lake County.

 

Delivery is by appointment only. After purchase, The Compass Gallery will contact the purchaser to coordinate a delivery date and time. Someone 18 years or older must be present to receive and sign for the delivery. Local delivery includes delivery to the stated address and placement in a reasonable location as agreed at the time of scheduling. Wall installation, mounting, hardware, and specialized installation are not included unless separately agreed in writing.

 

The purchaser is responsible for ensuring safe and reasonable access to the delivery location (including stairs, elevators, parking/loading access, and any required building approvals). If delivery cannot be completed due to conditions outside our control, the delivery may be rescheduled or canceled. We reserve the right to decline local delivery if we determine that delivery conditions are unsafe or likely to risk damage to the artwork, the property, or our staff.

 

Responsibility for the artwork transfers to the purchaser upon delivery and acceptance at the delivery location.

Unclaimed Artwork

All purchased artwork must be collected within 120 days (four months) of the purchase date. If the item remains uncollected after this period, it will be considered abandoned property.

 

If the artwork remains uncollected after 120 days, The Compass Gallery will make a good-faith effort to contact the purchaser using the information provided at checkout, including a minimum of three (3) attempts by email and three (3) attempts by phone call or text message.

 

If the artwork is not picked up by the 120-day deadline, a storage fee of $10 per day will begin accruing on the 121st day. Storage fees must be paid in full before the artwork will be released.

If the artwork remains unclaimed and storage fees remain unpaid for an additional 30 days (totaling 150 days from the purchase date), the purchaser authorizes The Compass Gallery to take steps to recover unpaid storage and related costs, including selling, donating, or otherwise disposing of the artwork to the extent permitted by applicable law, after providing any additional notices required by law. Any remaining proceeds (after costs and fees) will be handled as required by applicable law.

The Compass Gallery’s decision to delay enforcement of this policy does not waive its right to enforce it later.

Damaged Shipments

 

Please inspect your order upon arrival. If an item arrives damaged:

  • Contact us within 48 hours of delivery at events@thecompassgallery.com

  • Include photos of the item, packaging, and shipping label

  • Keep all packing materials until the claim is resolved

We will work with you to determine the best solution, which may include repair, replacement (if possible), or refund, depending on the item and circumstances.

 

Returns, Exchanges, & Final Sale

Original artwork: Returns may be accepted within 14 days of purchase (if purchased in person at the Compass Gallery) or delivery (if purchased online and shipped) for original artworks in their original condition. We offer store credit only for returns of original artworks.

 

Prints and merchandise: Returns may be accepted within 14 days of purchase (if purchased in person at the Compass Gallery), pickup (if purchased online and picked up at the Compass Gallery), or delivery (if purchased online and shipped) for unused items in original condition.

 

The customer is responsible for return shipping. Original shipping costs are non-refundable.

We cannot accept returns for:

  • custom orders

  • items damaged after delivery

  • event tickets (see below)

 

Event Tickets & Programs

 

Unless otherwise stated:

  • Tickets are non-refundable

  • Tickets are transferable

  • If an event is canceled by the gallery, ticket holders will be offered a refund or option for in-store credit

  •  If an online-view event becomes unavailable due to a technical issue on our end (and we’re unable to restore access within a reasonable time), online-view ticket holders may request a full refund. Refund eligibility applies only to technical issues on our end (for example, a streaming outage). Issues related to a ticket holder’s device, internet connection, or local network are not eligible for refunds.

  • We reserve the right to refuse entry or remove attendees for behavior that is disruptive, threatening, harassing, or unsafe.

 

Copyright, Trademarks & Content Use

All artwork images and content remain the intellectual property of the artist. Purchasing artwork does not grant the buyer reproduction or commercial usage rights. No copying, licensing, or commercial use is permitted without written permission from the artist.

 

All content on this website—including our name, logos, trademarks, graphics, photographs, videos, text, designs, and site layout—is owned by or licensed to The Compass Gallery and is protected by intellectual property laws. You may view, download, or print content only for personal, non-commercial use. You may not copy, reproduce, modify, publish, distribute, sell, or create derivative works from our content without prior written permission from The Compass Gallery.

Social Sharing (Non-Commercial)


You’re welcome to share our posts or images on social media for non-commercial purposes, provided you credit The Compass Gallery and, when applicable, credit the artist and/or tag the original source. This permission does not allow commercial use, resale, printing, licensing, or use of our content (or artists’ work) in advertisements, products, or promotions without written permission.

Gift Cards

Gift cards do not expire and do not have any dormancy, service, or inactivity fees unless an expiration date is explicitly stated on the gift card (or accompanying materials) as permitted by law. Gift cards are non-refundable and are not redeemable for cash, except where required by law.

 

Gift cards may be redeemed online and/or in-gallery toward eligible purchases. 

  • Gift cards may not be used to purchase additional gift cards.

  • Gift cards may not be applied to event tickets.

 

Treat gift cards like cash. Lost, stolen, or deleted gift cards may not be replaced. If you have proof of purchase, contact us and we will do our best to help. We reserve the right to refuse, cancel, or limit gift card transactions where we suspect fraud, unauthorized activity, or policy abuse.


 

Chargebacks & Payment Disputes

If you have an issue with your order or ticket, please contact us first—we’re happy to help resolve it quickly. If a chargeback or payment dispute is initiated, we reserve the right to pause fulfillment and/or revoke access to digital tickets while the dispute is being reviewed.

 

We are not responsible for delays or failure to perform caused by events beyond our reasonable control (including natural disasters, power outages, shipping disruptions, or government actions).

 

Limitation of Liability

We do our best to provide a smooth experience online and in-gallery. However, to the fullest extent permitted by law, The Compass Gallery is not responsible for indirect or unexpected damages (such as, but not limited to, lost time, travel expenses, or missed opportunities). Our total liability for any claim related to a purchase or ticket will not exceed the amount paid for that item or event.

 

Governing Law

These Terms are governed by the laws of the State of Utah, United States.
